Force Majeure. The Seller shall not be responsible or liable for its failure to perform its obligations hereunder, if such is beyond the control of the Seller caused by unavailability, shortages of Goods, transportation's, acts of god, fire, flood, strikes, riots, restriction, or any other cause, the Seller shall be excused.

Guarantee. The Seller warrants that the Goods will be free from defect in material and workmanship under normal use, provided the Goods have been commissioned and operated in accordance with manufacturers instructions. The Seller makes no other warranties, expressed or implied in respect to the Goods, their quality or fitness or marketability for any specific use or purpose. Goods warranty only applies to the Seller not the third party and no liability or consequential damages in respect of any malfunctions arising from fair wear & tear, willful damage, negligence, misuse, abnormal and weather conditions, modifications, or repair of Goods by unqualified personnel is accepted. The commencement date of all warranties is the date of delivery to the Buyer from the Seller. The Seller shall be under no obligation to guarantee the Goods or installation if the buyer has not paid for the goods in full, or the Seller has not been notified of any defect in the goods within one month of the defect taking place. All defects should be notified to the Seller in writing

Returns. With Sellers prior consent in writing, the Buyer can return Goods, carriage paid and insured, for credit, provided Goods are unused and are in original manufacturers packaging, within 30 days from the date of delivery. A minimum restocking charge of 20% will be made for non-stock items. Stock items will incur no restocking charge. Any Goods supplied as 'Special order' will not be either cancelled or returned for credit.

Goods in Transit. The Seller will insure the Goods during transit until received and signed for by the Buyer's representative, at which time responsibility for the Goods shall pass to the buyer.

Consequential Loss. The Seller shall not in any circumstances whatsoever be liable for indirect or consequential loss such as (but not limited to) loss of profit, loss of market or the consequences of delay or deviation however caused.

Law. All disputes arising out of or in connection with this contract shall be determined and governed by English Law.
